Recall that the D.C. circuit court ruled in favor of the constitutionality of the Public Company Accounting Oversight Board recently. But the ruling was 2-1. And the dissent by Judge Brett Kavanaugh called the board "unaccountable and divorced from presidential control to a degree not previously countenanced in our constitutional structure." That certainly seemed to give the PCAOB's detractors hope.

Unsurprisingly, the groups seeking to strike the PCAOB as unconstitutional have asked the Supreme Court to hear their case. So the saga continues. While there may be huge constitutional issues regarding presidential power at play, most agree that the PCAOB will continue to exist. Its relationship with the SEC may have to be reformulated.
