We have not heard the last of the decision by the appellate court in D.C. that found the Public Company Accounting Oversight Board to be legal. The plaintiffs have already said that they will appeal. And the New York Sun opines that "a devastating dissent by Judge Brett Kavanaugh all but begs for Supreme Court review. Our bet is that federal high court can, in its wisdom, be counted on to reverse." The guts of the case are dependent, not on anything related to Sarbanes-Oxley in practice, but rather on whether the board members are sufficiently under the control of the President. This is certainly not a referendum on the worth of the law. Still, it will be interesting. And foes of the law will certainly be making their voices heard.
