New stimulus provision to supersede Sarbox whistleblower?

Recall that Section 806 of Sarbanes-Oxley, on the surface anyway, provided protection for whistleblowing employees against retaliation by their employers. Recall also that few people have benefited from such protection, given that OSHA has ruled that employees of public companies' subsidiaries are not covered. The result: The government has ruled in favor of just a handful out of roughly 1,300 Sarbox whistleblower complaints. While some politicians aim to change that, more protection has already been passed with little fanfare via the stimulus act signed in February.

The new protections cover private employers and state and local governments "who disclose waste, fraud, gross mismanagement, or a violation of law related to stimulus funds," notes Mondaq, which also suggests that people should assume "any employer who receives a contract, grant, or other payment appropriated or made available by the stimulus bill, including private employers, federal government contractors and subcontractors, and state and local governments and their contractors and subcontractors" is covered.
