How to be prepared for a lawsuit

We live in a litigious society. Smart companies these days should expect to be sued. In some ways, electronic discovery stands as a great symbol of the Sarbanes-Oxley era. E-discovery can easily become the single largest cost of responding to litigation. "Not only are the costs of discovery growing, so are the consequences of mishandled production in response to discovery requests. At the same time, inadequate or dilatory responses have become more likely because the timetable for e-discovery responses and scheduling begins earlier and moves faster than ever before," notes Frank Wu, of Protiviti in an interview with The Metropolitan Corporate Counsel. Companies are increasingly aware of their burdens in this area, and more seem to be considering specific technology solutions when it comes to retention--and destruction--of data.
