More than 200 options backdating probes have been launched by federal authorities, and it shouldn't come as a surprise if more charges are handed up. One of the biggest issues facing companies is whether or not they should cooperate. Law.com notes that some companies have benefited. KLA-Tencor aggressively cooperated with investigators, and while the executives were charged, the company was spared. But there are many who argue that cooperation may be a double-edged sword. This is a tricky issue, to say the least. Hopefully, you will not have to face it. The best policy is to play no games with option grant dates.
