Are the Charles Schwab Sarbox whistleblowers faring any better?
Sarbanes-Oxley whistleblowers, as a group, have not fared well in the courts. Very few of the complaints of retaliation filed with OSHA, which administers Sarbox complaints, led to rulings favorable to the employer. Will the Charles Schwab whistleblowers fare any better?
The Department of Labor has just ordered the company to pay back pay and damages, including lawyer fees, to two employees who were fired in violation of Sarbox whistleblower provisions. They were also given their jobs back. Their complaint alleged that they were fired because they refused to participate in a scheme at a branch office to falsify entries in Schwab's database system. An OSHA investigation found that there was merit to the allegations. This will likely not be the end of the story.
